Terms of Service

• Age requirement:
  • You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
• Account security:
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
• Accurate information:
  • You agree to provide accurate, current, and complete registration information and to keep it updated.

Fitkub provides a wellness and fitness platform that may include, among other features: social feeds and Guilds, coaching tools, structured courses, biomarker tracking, AI-assisted insights (including meal and health analysis), digital and physical book sales, token-based purchases, marketplace listings, live seminars, challenges, and community content.

We may add, modify, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation of the Service.

Fitkub is not a medical provider. Content on the Service—including from coaches, creators, AI tools, courses, books, or community posts—is for general informational and educational purposes only. It is not medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before starting or changing any diet, exercise, supplement, or health program. Do not disregard professional medical advice because of something you read or receive through the Service. Use of the Service is at your own risk.

You agree not to:

• Violate any applicable law or regulation.
• Harass, threaten, defame, or abuse other users or staff.
• Post or share unlawful, obscene, hateful, or infringing content.
• Impersonate any person or entity or misrepresent your affiliation.
• Upload malware, scrape or reverse-engineer the Service without permission, or interfere with its security or performance.
• Use the Service for unauthorized commercial solicitation or spam.
• Circumvent access controls, token systems, paywalls, or digital rights management for books or other paid content.

We may remove content or suspend accounts that violate these Terms or harm the community, at our sole discretion.

• Pricing:
  • Prices for subscriptions, coaching packages, books, marketplace items, token packs, and other products are displayed at checkout. We may change prices prospectively.
• Tokens:
  • Tokens are a limited, non-transferable license to access eligible in-platform features or content. Tokens have no cash value, are not legal tender, and cannot be redeemed for cash except where required by law.
• Payment processing:
  • Payments may be processed by third parties (e.g., Apple App Store, Google Play, Stripe, Beam, or local payment providers). Your use of those services is subject to their terms.
• Refunds:
  • Refunds for books and certain digital goods are governed by our Return & Refund Policy. Other purchases may be non-refundable unless required by applicable law or explicitly stated at purchase.

When you purchase or access E-Books, courses, or other digital materials, you receive a personal, non-exclusive, non-transferable license to use that content for your own private purposes, unless a separate license is stated.

You may not reproduce, distribute, publicly display, sell, or create derivative works from digital content except as expressly permitted. Unauthorized copying or sharing may result in account termination and legal action.

Coaches, creators, and other users may publish content on the Service. They are responsible for their own content. Fitkub does not endorse user-generated content and is not liable for opinions, advice, or materials provided by third parties.

If you publish content, you grant Fitkub a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content in connection with operating and promoting the Service.

The Service, including its software, design, trademarks, and branding, is owned by Fitkub or its licensors and protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

The Service may integrate with or link to third-party websites, apps, wearables, payment providers, or AI services. We are not responsible for third-party products, policies, or practices. Your use of third-party services is at your own risk.

You may stop using the Service at any time. We may suspend or terminate your account if you breach these Terms, if required by law, or to protect the Service and other users. Upon termination, licenses granted to you end, but provisions that by nature should survive will remain in effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the maximum extent permitted by law, Fitkub and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or health outcomes arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to Fitkub in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited under applicable law.

You agree to indemnify and hold harmless Fitkub and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.

These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Thailand for disputes that cannot be resolved informally, except where mandatory consumer protection laws in your country provide otherwise.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Continued use after the effective date constitutes acceptance of the updated Terms.
